WASHINGTON – The Federal Highway Administration (FHWA) April 17 officially relieved state transportation departments from nearly two years of uncertainty caused by the Biden administration’s greenhouse gas (GHG) performance mandate.

This action reaffirms states have the autonomy to pursue their own environmental policies on GHG emissions and follows decisions by two federal courts striking down the rule last year. In both cases, the courts decided that FHWA lacked the legal authority to issue the mandate. ARTBA had previously supported 22 states’ challenges to the rule and shared its opposition with the Trump administration.
