What happened: ARTBA Nov. 20 weighed in on the Department of Homeland Security (DHS) proposal to revise administration of the H2-B visa program for temporary workers. While the proposed rule focuses on worker protections, ARTBA emphasized the need to streamline paperwork for applicants and employers, as well as limit employer liability.

Why it matters:  Demand for skilled labor in transportation construction remains acute. ARTBA members have utilized or expressed interest in pursuing H2-B visas to supplement their domestic workforce needs. ARTBA stressed that DHS should not create conditions that discourage employers from participating in the program. Such disincentives could include imposing liability directly on the employer for actions of a third party assisting with the program’s administration. ARTBA also asked DHS to explore additional efficiencies that would shorten the process for favorably reviewed applicants who have already participated in the program. ARTBA supports the workplace protections and – at a minimum – streamlining the application process as proposed by DHS.

What’s next: DHS will review comments but has not set a deadline for publication of a final rule. ARTBA also continues exploring additional legislative and administrative options to improve immigration policies. For more information contact ARTBA’s Prianka Sharma.
