What’s happening: The U.S. Department of Justice (DOJ) is requesting information on state regulations that adversely affect the national economy or interstate commerce. The request follows an Executive Order issued by President Donald Trump Feb. 19 requiring agencies to identify burdens that raise costs or impede markets.

Specifically, DOJ wants to know about any state laws that may conflict with federal authority. While generally states retain authority to regulate within their borders, in limited instances, federal law can override state requirements.

Why it matters: Different state standards can create uncertainty for transportation construction projects that cross state lines or for companies expanding into new markets, particularly where state requirements are more stringent than federal rules.
