What happened: The Federal Highway Administration (FHWA) Sept. 29 published a revised Form 1273, incorporating recent changes to Davis-Bacon regulations. FHWA asked ARTBA to notify its members of this revision, which spells out mandatory contractual provisions for federal-aid highway projects.

Why it matters: On Aug. 8 the U.S. Department of Labor (DOL) finalized updates to the Davis-Bacon regulations. This latest rule will modify prevailing wage policies for direct federal and federal-aid construction projects. Accordingly, FHWA has issued a new Form 1273 and posted a summary of which sections have been modified.

What’s next: The revised Davis-Bacon rule is scheduled to take effect on Oct. 23, as will FHWA’s new Form 1273. Contractors with direct federal and federal-aid projects are affected.
