What happened: The Trump administration signaled a ramp up of efforts to cut burdensome federal rules when it issued an April 9 memo directing agencies to repeal regulations that conflict with 10 U.S. Supreme Court rulings, including Sackett v. EPA and Loper Bright. The Sackett decision, for which ARTBA filed an amicus brief, narrows the definition of “waters of the United States” (WOTUS), ending years of confusion for transportation project planners over which water bodies require federal permits and leaving no room for agency interpretations beyond the Court’s ruling.
 

Why it matters: The administration’s memo comes after both the U.S. Department of Transportation (DOT) and White House Office of Management and Budget (OMB) recently requested public input on which rules are ripe for repeal or reform. The requests present ARTBA members with an opportunity to help shape the outcome of administration policy on deregulation.
