ARTBA joined the Associated General Contractors of America and the Associated General Contractors of Minnesota in asking the Minnesota Supreme Court to consider the construction industry’s perspective in Ames Construction Inc. v. City of Moorhead, a case involving the application of the longstanding Spearin Doctrine in public construction contracts. The filing supports review of a lower court decision that could significantly limit contractors’ ability to reasonably rely on owner-provided project information, including geotechnical and subsurface data, during the bidding process.
