ARTBA joined the Associated General Contractors of America and the Associated General Contractors of Minnesota in filing an amicus brief before the Minnesota Supreme Court in Ames Construction Inc. v. City of Moorhead. The brief urged the court to reaffirm the longstanding Spearin Doctrine and contractors’ ability to reasonably rely on project information provided by public owners during bidding. The groups argued that limiting this protection would increase bid costs and timelines, reduce competition, and improperly shift project risks to contractors and taxpayers.
