ARTBA shared the following statement at an industry listening session hosted by the U.S. Environmental Protection Agency (EPA) and the U.S. Army Corps of Engineers (Corps). The agencies convened the session to gather feedback from regulated entities about implementation of the Waters of the U.S. (WOTUS) rule following the Supreme Court’s Sackett decision and the agencies’ issuance of a conforming rule in 2023.

ARTBA stressed that members deserve to know how decisions are being made, adding that critical transportation infrastructure projects that improve safety and reliability should not be delayed simply because permitting agencies refuse to engage in clear, transparent, and public implementation principles grounded in law, not ideology.
