At a recent EPA and U.S. Army Corps of Engineers listening session, ARTBA emphasized the urgent need for regulatory clarity following the Supreme Court’s Sackett decision and the agencies’ 2023 conforming WOTUS rule. ARTBA called for a commonsense revision to eliminate ambiguity, protect longstanding exclusions for roadside ditches, and prevent delays to essential transportation projects. The association stressed that clean water and clear rules are not mutually exclusive—and that the permitting process must be rooted in legal clarity, not bureaucratic inconsistency, to keep vital infrastructure moving forward.
