On Sept. 4  ARTBA and industry partners filed an amicus brief with the U.S. Supreme Court challenging a Circuit Court decision that expanded NEPA reviews beyond federal agencies’ regulatory authority.

The brief argues that the lower court’s decision improperly expands NEPA’s scope, potentially delaying projects, increasing costs, and granting unwarranted regulatory power to federal agencies against congressional intent.

ARTBA and its allies urged the Supreme Court to reverse the decision, preserving a balanced approach that considers both economic development and environmental protection in NEPA reviews.
