ARTBA and industry partners filed an amicus brief on July 3 in Federal District Court, supporting a legal challenge to OSHA’s Worker Walkaround rule.

The brief argues that OSHA lacks the authority to implement this expansive regulation and that it violates the Administrative Procedure Act by failing to justify its necessity. Effective May 31, the rule allows anyone deemed “reasonably necessary” to join OSHA inspectors during jobsite inspections, which ARTBA warns could undermine safety efforts.
