Coalition Comments EPA Water Quality Certification Program

ARTBA joined a broad coalition of industry organizations in submitting comments to the U.S. Environmental Protection Agency on proposed revisions to the Clean Water Act Section 401 water quality certification regulations. The coalition supported EPA’s effort to improve transparency and predictability in the certification process and urged the agency to maintain clear limits on the scope of review, adhere to the statutory one-year decision deadline, and prevent post-certification reopenings that create project uncertainty. The comments emphasized the need for a consistent, efficient permitting framework that protects water quality while avoiding unnecessary delays for transportation and other infrastructure projects.
