ARTBA joined a national coalition  in submitting comments to the U.S. Department of Labor (DOL) on its proposed rule governing joint employer status under the Fair Labor Standards Act, Family and Medical Leave Act. The coalition supported the proposed rule as a more predictable and durable framework for determining joint employer liability while recommending targeted revisions to provide greater certainty for employers. The comments asked DOL to clarify that ordinary business-to-business relationships, contractual provisions, and routine compliance measures should not create joint employer liability absent meaningful control over employees’ terms and conditions of employment.
