Coalition Comments on EPA Water Permitting Program

ARTBA joined a coalition of industry associations in urging EPA to streamline and clarify the Clean Water Act Section 401 certification process. The coalition’s comments—submitted to EPA —called for strict adherence to the one-year statutory deadline, limits on state authority to revise certifications after issuance, and a narrowed scope focused solely on water quality impacts. The comments also advocated for categorical exclusions for low-impact activities and more predictable permitting timelines to avoid project delays and legal uncertainty.
