ARTBA submitted comments to the U.S. Department of Justice’s Anticompetitive Regulations Task Force in response to its request for information. ARTBA focused on two key barriers to innovation: the FHWA’s continued ban on proprietary products in the Manual on Uniform Traffic Control Devices (MUTCD), and the mandate for project labor agreements (PLAs) on direct-federal projects of $35 million or more.

ARTBA urged FHWA to lift the MUTCD’s proprietary product ban—an outdated policy that stifles safety innovation and burdens small businesses. Similarly, mandated PLAs restrict contractor flexibility and limit competitive bidding, ultimately driving up project costs.
