ARTBA submitted comments to the U.S. Department of the Interior in response to its request for information on regulatory reform. ARTBA’s comments focused on two key issues under the Endangered Species Act: the recent expansive new rules on critical habitat and species listings, and the reinstatement of enforcement for incidental take under the Migratory Bird Treaty Act.

ARTBA urged the Department to revise these policies, which impose costly, uncertain compliance burdens without measurable environmental benefits. Instead, ARTBA called for science-based, transparent rules that promote both conservation and timely project delivery.
