Comments Supporting Reissuance of Nationwide Permits

ARTBA submitted comments to the U.S. Army Corps of Engineers supporting prompt reissuance of the Nationwide Permits (NWPs) to avoid regulatory gaps and keep projects moving. The letter urges a two-step approach: reauthorize the permits now, then pursue broader improvements through future rulemaking.

ARTBA also recommends updates to NWP 23—which incorporates categorical exclusions issued by the Federal Highway Administration under the National Environmental Policy Act—to improve clarity and consistency, and calls for faster processing and modernized thresholds in a second-phase reform.
