ARTBA joined a broad coalition of national trade associations, state organizations, and industry partners (including the association’s California chapters) in submitting comments to the California Division of Occupational Safety and Health (Cal/OSHA) opposing a proposed “worker walkaround” regulation. The proposal closely mirrors a rule finalized by federal OSHA in 2024 that ARTBA opposed. ARTBA is also supporting ongoing litigation challenging that rule through an amicus filing. The coalition raised concerns that the proposal would significantly expand third-party access to private worksites in ways that exceed statutory authority, create legal and constitutional risks, and undermine established inspection practices. The comments emphasized the importance of maintaining a balanced framework that protects worker safety while preserving employer rights, trade secrets, and the cooperative relationships that support effective enforcement.
