On July 3, 2025, DOT finalized an interim rule updating its procedures for implementing the National Environmental Policy Act (NEPA) across the Federal Highway Administration (FHWA), Federal Transit Administration (FTA), and Federal Railroad Administration (FRA). While the rule takes immediate effect, the agencies are seeking public comment and may revise further. The rule aligns DOT’s NEPA procedures with key statutory requirements included in the Fiscal Responsibility Act (FRA) and the Infrastructure Investment and Jobs Act (IIJA) and introduces several DOT-specific reforms.
