ARTBA and industry partners filed an amicus brief with the U.S. Supreme Court on July 26, supporting a challenge by the City and County of San Francisco to the EPA’s Clean Water Act permit requirements. The coalition argues that vague language around “violating water quality standards” creates legal uncertainties for construction permit holders.

ARTBA urged the Court to maintain the current permitting process to avoid unpredictable enforcement, increased compliance costs, and potential project delays, particularly for transportation infrastructure projects.
